PIC Terms of Service

These Terms govern access to and use of the PIC (People Instant Choice) mobile application and backend services, together referred to as the Service.

By creating an account and accepting these Terms during registration, you enter into an agreement with us. If you do not agree to these Terms, do not create an account or use the Service.

Our Privacy Policy separately explains how we process personal data. It is a privacy notice, not a term that reduces or replaces any right you have under data-protection law.

1. Pre-release service

PIC is under active development and is currently being tested. During this period:

2. Eligibility and age

You must be at least 14 years old, or any higher minimum age required by the law applicable to you. If applicable law requires authorization from a parent or legal guardian for you to enter into these Terms, you may use PIC only with that authorization.

By registering, you confirm that you meet the applicable age and authorization requirements, have legal capacity to agree to these Terms, and have provided accurate registration information. We may suspend or end access where those requirements are not met.

3. Your account and licence to use PIC

You must keep your credentials confidential and take reasonable steps to protect your account. Notify us promptly at [email protected] if you believe another person has accessed it. You are responsible for activity you authorize and for activity resulting from your failure to comply with these security obligations, to the extent permitted by law.

Unless we expressly permit otherwise, each person may maintain one account. You must not create additional accounts to manipulate poll results, avoid restrictions, or impersonate another person.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install, access, and use PIC for your own non-commercial use. PIC, its software, branding, design, and service materials remain owned by us or our licensors. No right is granted except the limited right to use the Service under these Terms. Your ownership of content you submit is addressed separately in section 6.

4. How PIC works

PIC allows a poster to publish a binary poll containing photographs and allows other users to choose between the available options.

Poll results reflect only the responses received from PIC users. They are not scientific surveys and may not be representative of any wider group.

5. Vote visibility and attribution

Voting is attributed, not anonymous. Before voting, read the following rules because a vote is final while your account exists.

Results and counts

While a poll is live, its percentage result and vote count are visible to the poster and to users who have already voted on it. After the poll closes, they are visible to anyone permitted to see the poll.

Profile identity beside votes

When you vote, your username, display name and profile photo are shown beside the option you chose to every user permitted to see that poll's results. While the poll is live, that audience is its poster and users who have already voted; after it closes, it is anyone permitted to see the poll.

PIC provides no anonymous voting setting or per-vote override. While your account exists, you cannot change or withdraw an individual vote or make its attribution anonymous. If you would prefer not to be identified on a poll, do not vote on it.

Users who are not permitted to see a poll's results see no voter identities and no vote count. Accounts separated by a block are not shown to one another in the voter list, although their existing votes still count. After account deletion, votes cast on other users' polls continue to count but are shown without the deleted account's profile identity, as described in section 10.

PIC does not publish a service-wide history of polls you have voted on. A vote may appear only on the poll where it was cast, subject to the rules above.

6. Your content

You retain ownership of the photographs, labels, questions, and other material you submit to PIC, together referred to as Content. You are responsible for your Content.

By submitting Content, you confirm that:

The person shown in a photograph is not necessarily the copyright owner. If another person took the photograph, you must also have the photographer's permission or another valid right to use it.

To operate the Service, you grant us a worldwide, non-exclusive, royalty-free, transferable, and sublicensable licence to host, store, process, reproduce, resize, crop, moderate, and display your Content. This licence may be exercised only to provide, secure, maintain, moderate, and technically improve the Service, including through service providers acting for us. It continues only while we retain the Content, including any limited backup or legal-retention period.

This licence does not permit us to sell your photographs, use them in advertising, or license them to another person for that person's independent purposes.

8. Reporting, blocking, moderation, and review

Reporting content or accounts

Signed-in users can report a poll from the menu on that poll and an account from that account's profile. You choose a reason and may add a note; a note is required when you choose "Something else" so that we know what to review.

Anyone may also report content or an account by emailing [email protected]. An account is not required. Include enough information for us to locate the content or account and understand why you believe it is unlawful or breaches these Terms. We may request more information where needed.

Reports are not shown to the person reported. We do not tell them that a report exists or identify the reporter. Reviewers can see who filed a report so that they can evaluate it fairly; the Privacy Policy explains exactly what they see. A report enters a human review queue and does not restrict content by itself.

Blocking other accounts

You may block another account from its profile or from the menu on one of its polls. While a block is in place, the two accounts cannot reach one another's content, results, voter entries, profiles, or shared links, and neither can vote on the other's polls.

A block is not announced. Accounts you blocked remain listed for you in Settings so that you can remove the block; to the blocked account, your profile and polls simply appear unavailable.

Blocking removes following relationships and pending follow requests in both directions and prevents new ones while the block remains. Existing votes are not withdrawn and still count, but the two accounts are not shown by name to one another. Removing a block does not restore a following relationship or request that the block removed.

Blocking is your own control over one other account, not a moderation decision. It creates no report or restriction for anyone else. If you believe content or conduct breaches these Terms, you may report it whether or not you also block the account.

Automated checks before publication

Photographs submitted for a poll or as a profile photo may be assessed automatically before publication. When automated screening is enabled, an assessment that identifies prohibited content may cause the submission to be refused. A technical failure may also prevent publication until the check can be completed. The Privacy Policy explains the provider, processing, and records involved.

Moderation after publication

Content is not hidden automatically after publication. A report is placed in a review queue, and every restriction after publication follows human review. If a decision is ever made by automated means, the detailed notice described below will say so.

After review, we may restore or remove Content, limit its visibility, suspend or terminate an account, or take another proportionate step needed to protect users, maintain the Service, or comply with law. When applying these restrictions, we will consider the circumstances and applicable rights, including freedom of expression.

Notice and review

Where required by law, detailed reasons for a moderation restriction are sent to the affected user by email. The email does not identify a reporter.

To request the reasons for a decision or a human review, email [email protected]. Identify the affected poll or account and explain why you believe the decision should be changed. A human will review the request. The same email review is available if you believe an automated pre-publication check refused a photograph incorrectly.

9. Suspension and termination by us

We may restrict, suspend, or terminate access where you materially or repeatedly breach these Terms, manipulate poll results, create legal or security risk, harm other users, or where the law requires action.

Where appropriate, we will provide notice before acting. We may act without advance notice where immediate action is reasonably necessary to protect another person, preserve security, prevent further abuse, or comply with law. Any notice and review rights are subject to section 8 and applicable law.

Termination does not affect provisions that must reasonably continue after the account ends, including rights concerning retained Content, liability, governing law, and records retained under the Privacy Policy.

10. Deleting your account

You may permanently delete your account through the app or the public account-deletion page. Deletion is not a temporary deactivation and cannot be reversed.

The deletion process starts immediately by destroying your identifying account and authentication records and beginning cleanup of the remaining data. A background process then removes or replaces identifying references in those remaining records. Section 8 of the Privacy Policy explains the process in detail.

The questions, option labels and photographs from your polls are deleted, and those polls stop being viewable. A content-free record of each poll, the votes cast on it and its interaction events remain only to preserve aggregate product metrics; the author reference on each retained poll and the account reference on your own retained activity are replaced with a fresh random reference that is not linked to your deleted profile. Votes you cast on other users' polls also remain so that their results do not change.

11. Availability and changes to the Service

We may modify, suspend, or discontinue all or part of the Service. We do not guarantee that PIC will always be available, uninterrupted, secure, or error-free, or that data will never be lost. Section 1 describes the additional limitations that apply during pre-release testing.

Nothing in this section limits a mandatory consumer right or any obligation concerning content or features for which you have paid.

12. Fees

PIC is currently free. If we introduce paid features, we will disclose the applicable price and terms before purchase. Purchases made through Apple or Google are also subject to the relevant store terms.

We do not currently pay or otherwise reward users for posting Content, voting, or generating engagement. Any future incentive program would require separate terms and safeguards and would not permit conduct prohibited by section 7.

13. Disclaimers and liability

To the extent permitted by law, we do not guarantee that the Service will meet a particular purpose, that user Content is accurate or lawful, that poll results are meaningful or representative, or that the Service will be continuously available or free from defects.

To the extent permitted by law, we are not liable for indirect or consequential loss arising from use of or inability to use the Service, user Content, poll results, data loss, or acts of third parties. Where we are liable, our total liability arising from the Service or these Terms is limited to the greater of the amount you paid us during the preceding 12 months and EUR 100.

Nothing in these Terms limits or excludes liability where doing so would be unlawful, including liability for fraud, death or personal injury caused by negligence, or any liability that Italian or European Union consumer law does not permit us to limit. If you are a consumer, your mandatory statutory rights remain unaffected.

14. Changes to these Terms

We may update these Terms as the Service develops or legal requirements change. The current version and effective date appear at the top, and we record the version accepted when an account is created. During PIC's pre-release drafting period, corrections and clarifications may be incorporated into v1 without a new history entry. After that period, material changes will receive a revised effective date and version.

We will provide notice of material changes before or when they take effect, as appropriate. Where applicable law requires renewed consent, we will ask you to accept the revised Terms. Otherwise, continued use after the effective date constitutes acceptance only to the extent permitted by law. If you do not agree to revised Terms, you may stop using PIC and delete your account.

16. Governing law and disputes

These Terms are governed by Italian law, without depriving a consumer of any mandatory protection provided by the law of the consumer's country of residence.

Please contact us first so that we can try to resolve the matter directly. If you are a consumer, you may bring proceedings in any court made available to you by mandatory law. For disputes not involving a consumer, the courts of Milan, Italy have exclusive jurisdiction.

17. General terms

If any provision of these Terms is invalid or unenforceable, the remaining provisions continue in effect. A failure or delay in enforcing a provision is not a waiver of that provision.

You may not transfer your rights or obligations under these Terms without our consent. We may transfer these Terms as part of a transfer of the Service, provided that the transfer does not reduce your rights.

These Terms constitute the agreement between you and us concerning use of the Service, together with any additional terms expressly presented and accepted for a particular feature or purchase.

18. Apple App Store terms

This section applies only if you obtained PIC through the Apple App Store. If this section conflicts with another part of these Terms for an App Store copy of PIC, this section prevails to the extent of the conflict.

  1. Acknowledgement. These Terms are between you and us, not Apple. We, not Apple, are solely responsible for PIC and its content. These Terms are not intended to conflict with the Apple Media Services Terms and Conditions.
  2. Scope of licence. Your licence to use PIC is non-transferable and is limited to Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. PIC may also be accessed by other accounts associated with you through Family Sharing or volume purchasing where Apple permits it.
  3. Maintenance and support. We are solely responsible for maintenance and support for PIC. Apple has no obligation to provide maintenance or support services.
  4. Warranty. We are solely responsible for any product warranty that applies and has not been validly disclaimed. If PIC fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. PIC is currently free, so that amount may be zero. To the maximum extent permitted by law, Apple has no other warranty obligation concerning PIC. We are responsible for any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to an applicable warranty.
  5. Product claims. We, not Apple, are responsible for addressing claims relating to PIC or your possession or use of it, including product-liability claims, claims that PIC does not conform to legal or regulatory requirements, and claims under consumer-protection, privacy, or similar law. These Terms do not limit our liability beyond what applicable law permits.
  6. Intellectual-property claims. If a third party claims that PIC or your possession and use of it infringes that party's intellectual-property rights, we, not Apple, are responsible for investigating, defending, settling, and resolving that claim.
  7. Legal compliance. You represent that you are not located in a country subject to a United States Government embargo or designated by the United States Government as a "terrorist supporting" country, and that you are not listed on a United States Government list of prohibited or restricted parties.
  8. Developer contact details. Our name, postal address, telephone number, and email address for questions, complaints, and claims appear in section 15.
  9. Third-party terms. You must comply with applicable third-party terms when using PIC, including the terms of your wireless-data provider.
  10. Third-party beneficiary. You and we acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple may enforce them against you as a third-party beneficiary.
